Texas Tort Reform Discussed on the Boss Business Brief with Toby Mathis

Small Businesses crave certainly. Known risks can be dealt with. That is why frivolous lawsuits are such a nuisance to small business - because irrational plaintiffs can literally hold a business hostage demanding a "right to a jury trial" or, as many lawyers know "a pull of the jackpot handle".

The issue in tort reform is not limiting a plaintiff's rights to access to the system; rather, it is forcing a plaintiff to act reasonably.

Texas has shown a remarkable ability to make itself attractive to businesses even in the middle of hard economic times. Texas has recently past additional legislation to help themselves in the form of tort reform.

Something as basic as allowing a defendant to recover attorneys fees if they give a plaintiff a reasonable settlement offer that the plaintiff rejects can have a positive impact on businesses by giving them much needed recourse against unreasonable plaintiffs.
